This bill allows cities which have a municipal street sales tax to call an election to authorize the tax for a period of 8 to 10 years if a majority of voters approved the tax in the last 2 elections. In most cities, the duration of the tax is limited to 4 years. Additionally, the bill expands the permitted uses of the tax to include not only maintenance and repair of streets and sidewalks, but now also water, wastewater, or stormwater systems located under a city street. Oppose is the position of the Texas GOP Platform under Spending Restraint Section 75: "Government Spending and Taxation". We believe in the principles of constitutionally limited government based on federalist principles. To this end, we encourage our elected officials at all levels of government to work to reverse the current trend of expanding government and the growing tax and debt burdens placed on “We the People.” Government spending is out of control at the federal, state, and local levels, and action is needed to reduce spending, and therefore taxation, at all levels. 

Reducing Government and Fiscal Accountability by Allowing Municipal Tax Levies to Continue for up to 10 Years (Previously 4 Years) without Voter Approval.

This bill is largely targeted towards online providers of clear orthodontic aligners such as SmileDirectClub. Under the bill, clear aligners (which are similar to braces) are now classified as a "medical device" and can't be provided to an individual unless they undergo an in-person examination by a dentist, receive dental x-rays, and are provided a prescription for their usage by a dentist. SmileDirectClub was forced into bankruptcy and shutdown on December 21, 2023. Oppose is the position of the Texas GOP Platform under Markets and Regulation Section 41: "Reduce Business Regulations". "We believe that .. businesses should be minimally regulated at all levels". 

Expanding Government Power in the Orthodontics Industry to Shutdown Competition by Online Providers of "Clear Aligners" such as SmileDirectClub.

This bill prohibits local governments across the state from imposing any ordinances which directly regulate greenhouse gas emissions, with the state given exclusive regulatory authority. As a result, the bill would preempt local regulations that restrict greenhouse gas emissions. Support is the position of the Texas GOP Platform under Energy and Environment Section 57: "Environment". "We oppose environmentalism that obstructs legitimate business interests and private property use, including the regulatory taking of property by governmental agencies. We support the defunding of “climate justice” initiatives, the abolition of the Environmental Protection Agency, and repeal of the Endangered Species Act."

Protecting Against Local Government Overreach by Ensuring Only the State Can Regulate Greenhouse Gas Emissions.

This bill provides greater legal clarity to ensure doctors can prescribe certain off-label drugs without facing any disciplinary actions from the state's professional licensing board. The bill is largely in response to physicians prescribing hydroxychloroquine sulfate and ivermectin to treat COVID-19 infections. Support is the position of the Texas GOP Platform under Healthcare Independence Section 142: "Right to Try". "We urge the Texas State Legislature and Governor to enact laws that protect patients’ and their doctors’ rights to have access to experimental or off-label medications and procedures that can potentially be lifesaving or improve quality of life without the Medical Board, Pharmacy Board, or Hospital Boards Interfering."

Strengthening Medical Freedom by Preventing Licensing Boards from Taking Actions Against Doctors for Prescribing Off-Label Drugs to Treat Conditions Such as COVID-19.

This bill creates a statewide framework for natural gas utility companies to offer energy conservation programs. These programs typically involve subsidies for purchasing higher energy efficiency appliances or for retrofitting a home or business to increase energy efficiency. The programs are paid for by raising natural gas utility rates on all customers through "rate recovery" which also provides utility companies a larger guaranteed profit. Additionally, the bill allows utility companies (which heavily lobbied for the bill) to receive additional profit for designing, marketing, administering, and delivering an energy conservation program. Oppose is the position of the Texas GOP Platform under Energy and Environment Section 53: "Utilities". "We support free-market solutions for providing resilient and reliable utilities."

Hiking Natural Gas Utility Costs for Texans to Enrich Utility Companies and Create New Energy Conservation Programs.

This bill eliminates the state's mandatory vehicle safety inspection effective January 1, 2025. As a result, car owners will no longer be forced to annually take their vehicle in for an inspection, however a $7.50 annual fee (the current inspection fee) will still be assessed on vehicle owners. Texas was one of only 13 states which required annual vehicle inspections. Support is the position of the Texas GOP Platform under Transportation Section 64: "Vehicle Taxes". "Only commercial vehicles should be required to obtain a state safety inspection."

Providing Significant Regulatory Relief to Car Owners by Eliminating the State's Mandatory Annual Vehicle Safety Inspection.

This bill establishes 10-year mandatory minimum sentences for individuals convicted of human smuggling and 5-year mandatory minimum sentences for operating a stash house (10 years if in an area subject to a declared state of disaster). The bill also enhances penalties for property damage that occurs as a result of concealing or harboring a person in the country illegally from a misdemeanor to a third-degree felony (2-10 years in prison). Support is the position of the Texas GOP Platform under Courts, Prosecutions, Restitution Section 187: "Human Trafficking Jurisdiction". "The Texas Legislature shall pass legislation granting the Texas Attorney General full concurrent jurisdiction over multi-jurisdictional cases, to be limited specifically to those cases involving human trafficking."

Strengthening National Security and Law and Order through 10 Year Mandatory Minimum Sentences for Human Trafficking.

This bill establishes a 10-year mandatory minimum sentence if a firearm was used to commit a very serious crime. Examples include felony offenses committed in the first, second or third degree such as murder, human trafficking, burglary, sexual assault, or kidnapping. Support is the position of the Texas GOP Platform under Courts, Prosecution, Restitution Section 188: "Rule of Law Enforcement". "We support rule of law and enforcement of laws, which maintain an ordered republic."

Strengthening Law and Order by Imposing 10-Year Mandatory Minimum Sentences for Serious Firearm Felonies.

This bill requires an aspiring dietician to now obtain a master's degree, register with a national commission, complete an internship or other accepted training program, and undergo examination to work in the profession. Oppose is the position of the Texas GOP Platform under Markets and Regulation Section 39: "Licensing". "We call upon the Texas Legislature to review all Texas Department of Licenses and Regulations (TDLR), business/professional licensing programs, and associated licensing for the purpose of abolishing or removing as many as reasonably possible and repealing those laws, rules, and regulations."

Increasing Employment Barriers and Enriching Certain Educational Institutions by Forcing Dieticians to Obtain Masters Degrees.

This bill updates the Residential Construction Liability Act to provide additional liability protections for contractors. Under the bill, contractors are not liable for residential construction defects unless actual physical damage occurs, part of a building is unable to be used for its intended purpose, or there is a verifiable danger to the residents. Contractors are also not liable for damages that result from a failure to provide timely notice of a defect. The bill also amends various provisions related to lawsuits arising from construction defects, such as allowing contractors additional time to make a settlement offer. Support is the position of the Texas GOP Platform under Courts, Prosecution, Restitution Section 184: "Frivolous Lawsuits". "We support further reform to discourage frivolous lawsuits. We oppose the abusive use of class action lawsuits and any law that allows government agencies to collect lawyer fees from the plaintiff when they win but not have to pay the plaintiff fees when they lose."

Reducing Frivolous Litigation by Updating the Residential Construction Liability Act to Limit Liability and Provide Clarifications.

This bill creates the "Texas Semiconductor Innovation Consortium," to, among other purposes, "develop a comprehensive strategic plan to ensure ongoing semiconductor innovation" and expand workforce training. The bill also creates the Texas Semiconductor Innovation Fund to provide grants to state government entities and semiconductor manufacturing and design companies in the state "to encourage economic development." Oppose is the position of the Texas GOP Platform under Opposition to Market-Distorting Tax and Fiscal Subsidies Section 95: "Bailouts and Subsidies". "We encourage government to divest its ownership of all businesses that should be run in the private sector. We oppose all bailouts of and subsidies to domestic and foreign government entities, states, and for all businesses, public and private."

Worsening Cronyism and Government Central Planning by Creating the Texas Semiconductor Innovation Consortium to Enrich Certain Companies.

This bill provides for the suspension or removal of judges for "persistent or wilful" violations of the laws relating to setting bail. The bill is largely in response to "reform-minded" judges (typically receiving financial support from George Soros) who refuse to impose bail or set it at low levels. Support is the position of the Texas GOP Platform under Courts, Prosecutions, Restitution Section 185: "Bail Reform". "We call upon the Texas Legislature to ensure bail in Texas is based only on a person’s danger to society, risk of flight, and criminal history."

Increasing Public Safety by Providing for the Removal of "Reform-Minded" Judges Who Promote Lawlessness by Persistently Failing to Impose Bail.

This bill contains several provisions related to the release of individuals charged with felonies. Most significantly, the bill prohibits the release of a defendant on their own recognizance (no bond required) if they are charged with certain offenses, such as manufacture or delivery of fentanyl, terroristic threats, or unlawful possession of a firearm. Additionally, a magistrate may not release a defendant charged with a felony unless the defendant appears before the magistrate and the magistrate has considered the public safety report, which includes the defendant's criminal history. The bill also allows prosecutors to appeal a bail amount as being insufficient if a defendant is charged with a felony and is already out on bail for another pending felony. "We call upon the Texas Legislature to ensure bail in Texas is based only on a person’s danger to society, risk of flight, and criminal history."

Strengthening Law and Order by Ensuring Bail is Imposed for Most Felony Offenses.

This bill imposes a series of new regulations on automobile dealerships pertaining to vehicle financing. For example, the bill imposes price controls which prevent a dealership from charging a customer a higher sales price if a buyer utilizes a third-party lender or offers cash. The bill is primarily directed at dealerships which offer discounts or condition vehicle sales on financing through preferred lenders. Oppose is the position of the Texas GOP Platform under Markets and Regulation Section 41: "Reduce Business Regulations". "We believe that .. businesses should be minimally regulated at all levels". 

Imposing Price Controls and New Government Mandates on Automobile Dealerships Pertaining to Vehicle Financing.

This bill, the Medical Freedom Act, expands on the state's Right to Try Act passed in 2015, which applied to individuals with terminal illnesses. Under this bill individuals with a severe chronic disease are also given the "right to try" an investigational drug, biological product, or device that has completed phase one of a clinical trial but is not yet approved by the FDA, if certain conditions are met. The bill also provides protections for doctors and manufacturers by providing legal immunity from any harm or injury that results from using the investigational product and ensures doctors can recommend such products without facing any disciplinary actions from the state's professional licensing board. Support is the position of the Texas GOP Platform under Healthcare Independence Section 142: "Right to Try". "We urge the Texas State Legislature and Governor to enact laws that protect patients’ and their doctors’ rights to have access to experimental or off-label medications and procedures that can potentially be lifesaving or improve quality of life without the Medical Board, Pharmacy Board, or Hospital Boards Interfering."

Strengthening Individual Liberties and Medical Freedom by Providing the "Right to Try" Experimental Drugs to treat Severe Chronic Diseases.

This bill establishes a new health insurance mandate which requires most healthcare policies offered in the state, including Medicaid (government-provided healthcare), that cover prescription contraceptive drugs to cover a 3-month initial supply and subsequent 12-month supplies of the drugs. Oppose is the position of the Texas GOP Platform under Government-funded Health Programs Section 146: "Welfare Reform". "We support the abolition of all federal welfare programs, as they are not an appropriate role of the federal government. Until such time, welfare reform should encourage partnerships with faith-based institutions, community, and business organizations to assist individuals in need. We oppose any further expansion of Medicaid."

Hiking Health Insurance Premiums by Mandating Insurance Companies Cover a 12-Month Supply of Contraceptive Drugs.

This bill requires school districts to allow parents the option to be notified whenever their child checks out materials from a school library, including the title and genre. Additionally, the bill prohibits school libraries from acquiring materials containing harmful, indecent, or profane content. Support is the position of the Texas GOP Platform under Parents' Rights Section 109: "Education Transparency". "We support requiring Texas public schools to be fully transparent with parents regarding everything to which their child is or will be exposed, without exception. We require that copyright and competitive advantage are not acceptable reasons to withhold information from a parent or taxpayer."

Strengthening Parental Rights in Education by Ensuring only Age-Appropriate Materials are Displayed in Public School Libraries.

This bill prohibits public institutions of higher education (colleges and universities) from funding or operating any Diversity, Equity, and Inclusion (DEI) Office. Furthermore, the bill bans institutions from conducting diversity trainings or asking prospective job applicants to provide diversity statements. Support is the position of the Texas GOP Platform under Higher Education Section 129: "Fund and Support Western Civilization Instruction, Defund Political Correctness". "Like Hillsdale College, we agree that state universities “should value the merit of each unique individual, rather than succumbing to the discriminatory trend of so-called social justice and multicultural diversity. We oppose using public funds for homosexuality, transgender, or diversity-equity-inclusion centers."

Protecting Taxpayer Funds from Being Utilized for Politicized "Diversity, Equity, and Inclusion" (DEI) Offices at Public College Campuses.

This bill prohibits county clerks, elections administrators, early voting clerks and certain other officials from suspending laws relating to acceptance of early mail-in ballots. This includes suspension of requirements such as the carrier envelope certificate being properly competed, the signatures being valid, and the ballot application stating a valid reason for voting early by mail. Support is the position of the Texas GOP Platform under Elections Section 242: "Fair Elections Procedures". "We support the right of eligible voters to cast a ballot in each election once, but we oppose illegal voting, illegal assistance, or ineligible persons. We support: Increased scrutiny and security in balloting by mail, including removal of Section 87.014 (d1) of the Texas Election Code to require once again full signature verification with the need to rebut, regardless of whether paper identification numbers are on the application and ballot carrier envelope."

Strengthening Election Integrity by Prohibiting Election Officials from Suspending Requirements for Mail-In Ballot Review.

This bill directs the Public Utility Commission to provide a method to establish an "annual energy savings goal" of 1% for each electric utility by 2030. This is in addition to the existing energy efficiency goals and programs. Oppose is the position of the Texas GOP Platform under Energy and Environment Section 53: "Utilities". "We support free-market solutions for providing resilient and reliable utilities."

Hiking Electricity Rates by Imposing a 1% Annual Energy Savings Goal by 2030 on all Utility Companies.

This bill provides an increase in the vehicle asset allowance under the supplemental nutrition assistance program (SNAP). As a result, an individual may now own a vehicle valued at up to $22,500 (previously $15,000) and still be eligible for the welfare program. Oppose is the position of the Texas GOP Platform under Government-funded Health Programs Section 146: "Welfare Reform". "We support the abolition of all federal welfare programs, as they are not an appropriate role of the federal government. Until such time, welfare reform should encourage partnerships with faith-based institutions, community, and business organizations to assist individuals in need.

Growing Government Dependency by Increasing the Vehicle Asset Allowance Under the SNAP Welfare Program from $15k to $22.5k.

This bill prohibits discussion of sexual orientation and gender identity in K-12 classrooms. The bill also requires school districts to adopt a policy related to school employees communicating with students outside of a human sexuality course and that directs employees to refer students to discuss such topics with a parent, counselor, or the student's teacher.  Support is the position of the Texas GOP Platform under Parents' Rights Section 106: "Inappropriate and/or Harmful Content". "We support passage of a law more comprehensive than the Florida law that prohibits instruction in sexual orientation and gender identity in public schools. We advocate for those who violate any of the above to have their educator’s certification revoked and be prosecuted to the fullest extent of the law where appropriate."

Strengthening Integrity of the Education System by Prohibiting Discussion of Sensitive Issues Surrounding Sexual Orientation and Gender Identity in K-12 Classrooms.

This bill extends the duration of postpartum coverage provided under Medicaid from 60 days to 1 year. Support is the position of the Texas GOP Platform under Life-Affirming Health Care Concepts Section 165: "Alternatives to Abortion". "We urge the Republican Party of Texas to support programs that provide assistance to pregnant women by: Ensuring women have medical insurance coverage up to one year postpartum, making it safer for pregnant women to give birth in Texas."

Increasing Government Dependency and Ballooning Medicaid Welfare Spending by an Additional $381 Million by Hiking Postpartum Benefits from 60 Days to 12 Months.

This bill prohibits local governments from utilizing public funds to hire a lobbyist to lobby state legislators or pay a state association that does so. The bill does provide an exception for legislation related to the military, service members, or veterans. Support is the position of the Texas GOP Platform under Government Operations Section 232: "Tax-Funded Lobbying". "We oppose using tax dollars to hire lobbyists or paying tax dollars to associations that lobby the Legislature."  

Protecting Taxpayers by Prohibiting Local Governments from Utilizing Public Funds to Lobby the Legislature.

This bill amends the public information request system by allowing government agencies to withhold information that it makes a good faith determination is exempt from public disclosure. This is intended to reduce the amount of attorney general decisions requested and reduce the response time for information requests, with appeals of decisions to withhold information permitted. The bill also allows the attorney general to fine any governmental entity $1,000 for submitting a bad faith request for an opinion, and an additional $500 each day until the requested information is provided to the requestor. Support is the position of the Texas GOP Platform under Government Operations Section 230: "Government Authority". "We believe any government authority that has the ability to levy a tax or fee or to appraise property on the people should be accountable to those who pay the taxes via the electoral process, from the local level to the federal level."

Strengthening Government Accountability and Transparency by Reforming the Public Information Request System to Quicken Response Times and Reduce Bad Faith Requests.

This bill prohibits "sexually oriented" shows and exhibitions from being performed on public property. Additionally, the bill requires any person or location that hosts such an exhibition (including drag shows) ensure minors are not allowed access. Support is the position of the Texas GOP Platform under Family and Gender Issues Section 209: "Protect Minors Until Age of Consent". "A law shall be enacted to protect the rights of the individual until the age of consent is reached. b. Protect against predatory sexual behaviors, including but not limited to “Drag Queen Story Hour.” 

Protecting Minors from Sexual Content by Ensuring Adult Entertainment is Not Performed on Public Property and that Minor Access is Restricted.

This bill, the Property Tax Relief Act, contains several provisions related to property taxes. Most notably, the bill increases the homestead property tax exemption from $40,000 to $100,000. Additionally, the bill enacts a "circuit breaker" provision on the appraised value of real property other than a residence homestead. As a result, the appraised market value of a property is limited to a 1-year increase of 20% plus any new improvements. Support is the position of the Texas GOP Platform under School Finance and Property Taxation Section 90: "Axe the Property Tax". "We support replacing the property tax system for businesses and individuals with an alternative other than the income tax and requiring voter approval to increase the overall tax burden. We urge the Legislature to immediately develop and implement a transition plan that is a net tax cut."

Providing Property Tax Relief to Homeowners by Raising the Homestead Exemption to $100,000.

This bill contains a major provision which requires taxpayers to fund "expanded access to broadband services in economically distressed communities". The new spending will unlock additional funds under the federal "Broadband Equity, Access, and Deployment Program" and is expected to provide significant new revenue to Comcast which lobbied for the bill. Other alternatives include Elon Musk's Starlink. Oppose is the position of the Texas GOP Platform under Opposition to Market-Distorting Tax and Fiscal Subsidies Section 95: "Bailouts and Subsidies". "We encourage government to divest its ownership of all businesses that should be run in the private sector. We oppose all bailouts of and subsidies to domestic and foreign government entities, states, and for all businesses, public and private."

Enriching Comcast and other Woke Corporations by Forcing Taxpayers to Provide "Broadband Equity" through a Government Central Planning Scheme.

This bill expands eligibility under the "Major Events Reimbursement Fund" to include a larger range of events ranging from Formula 1 to the country music awards, and equestrian competitions. Oppose is the position of the Texas GOP Platform under Opposition to Market-Distorting Tax and Fiscal Subsidies Section 97: "Special Funds". "We urge the Texas Legislature to abolish the Special Events Trust Fund program, the Texas Enterprise Fund, and the Moving Image Industry Incentive Program."

Worsening Cronyism and Government Central Planning by Forcing Taxpayers to Subsidize an Even Greater Range of Events (Formula 1 and Equestrian) under the "Major Events Reimbursement Fund".

This bill increases the penalty for tampering with a retail gas pump to steal fuel by making it a felony of the third degree. The bill is largely in response to organized criminal groups which have figured out how to disrupt fuel dispenser pulsers and as a result gain unlimited access to fuel. Support is the position of the Texas GOP Platform under Courts, Prosecution, Restitution Section 183: "Court Accountability". "We believe district attorneys have a duty to seek justice for victims of all forms of crime and oppose policies that systematically decline to prosecute crimes."

Strengthening Law and Order by Increasing Penalties for Tampering with a Gas Pump to Steal Fuel.

This bill establishes a new health insurance mandate relating to "biomarker testing" which is applicable to all private policies offered in the state and Medicaid. Specifically, the bill requires all policies to cover biomarker testing to diagnose, treat, manage, or monitor a person's disease or condition if the test is supported by "medical and scientific evidence." Oppose is the position of the Texas GOP Platform under Government-funded Health Programs Section 149: "Medicaid Reform". "We support Medicaid block grants to the states and returning Medicaid to its original purpose to be a temporary assistance program. We oppose any further expansion of Medicaid."

Increasing Health Insurance Premiums by Mandating All Policies Provide Coverage for Biomarker Testing.

This bill provides for the Centennial Parks Conservation Fund, created this legislative session via a constitutional amendment, to be used to purchase land "for the creation and improvement of publicly accessible state parks." The state budget included $1 billion in funding for this purpose. The state is currently tasked with managing and maintaining over 13 million acres of land under its control. Oppose is the position of the Texas GOP Platform under Land Use Section 222: "Property Rights". "Property ownership and free enterprise, the foundation of our collective wealth, must not be abridged nor denied by government. We support legislation to protect these bedrock rights. Areas of concern are: .. nationalization of land".

Further Growing Government's Unsustainable Land Holdings through a $1 Billion Centennial Parks Conservation Fund Program.

This bill imposes a series of new insurance mandates requiring automobile insurance policies offered in the state provide coverage for original equipment manufacturer (OEM) parts as opposed to less costly aftermarket parts. The bill applies to all policies covering vehicles 36 months old or newer. Additionally, the bill forbids policies from restricting the repair facility or persons performing repairs. Oppose is the position of the Texas GOP Platform under Markets and Regulation Section 41: "Reduce Business Regulations". "We believe that .. businesses should be minimally regulated at all levels". 

Hiking Automobile Insurance Premiums by Imposing New Mandates which Require Usage of OEM Parts for Vehicle Repairs.

This bill allows courts to remove district attorneys for misconduct if they refuse to prosecute certain types of crime. The bill is largely in response to cases of "reform-minded" prosecutors that have refused to prosecute crime or uphold the state's abortion laws. Support is the position of the Texas GOP Platform under Courts, Prosecution, Restitution Section 183: "Court Accountability". "We believe district attorneys have a duty to seek justice for victims of all forms of crime and oppose policies that systematically decline to prosecute crimes."

Strengthening Public Safety by Allowing Courts to Remove Rogue DAs which Refuse to Prosecute Crime.

This bill amends the existing state law which prohibits firearms on school grounds or buildings when a school-sponsored activity is taking place. Under this bill, the "gun free zone" only applies to the actual premises owned by a school (not off-campus locations). Support is the position of the Texas GOP Platform under Citizen Rights Section 32: "The Right to Keep and Bear Arms". "State and Federal Legislatures shall: Recognize the right of License to Carry holders to carry anywhere off-duty or retired law enforcement can carry."

Strengthening Self-Defense and Second Amendment Rights by Limiting School "Gun-Free Zones" to Only School-Owned Property.

This bill provides $100 million in funding to establish a new state border policing unit made up of commissioned peace officers. Funding is also directed to a number of initiatives designed to boost border security such as detention facility upgrades, temporary border barriers and compensation to certain property owners impacted. Support is the position of the Texas GOP Platform under Border Security and Immigration Section 256: "Border Security Funding". "We expect both the Texas Legislature and the United States Congress to make a priority of allocating funds to effectively secure the border through whatever means necessary, including but not limited to barriers, a border wall, and/or fence everywhere along the border where it is feasible and useful, as well as personnel and technology over land, sea, and air. Texas shall seek repayment from the Federal Government for expenses incurred in securing the border."
